Welcome to the DGM website terms and conditions for use.  Please read through them carefully before placing your order.  By using this website and/or placing an order you agree to be bound by these terms and conditions.  They govern your use of the website and your relationship with DGM. (Reference to “we” or “us” are also references to DGM).  Reference to “you” is a reference to the purchaser of the Goods from us.  Please read the terms and conditions carefully as they affect your rights and liabilities under the law. If you do not agree to these terms and conditions, please do not register for or use the website.

To be eligible to purchase items on this website you must be the holder of a valid credit/debit card. Personal information you are required to provide must be true, accurate and current in all respects.

Security

Payments are processed by Worldpay on behalf of HSBC Merchant Services on their secure server.  This is a very safe and unique system and as a result DGM does not at any time view your card details.  This is an added level of security that DGM have installed for your protection to allow safe and worry free internet shopping.

Contract

The purchase of goods through DGM is strictly limited to parties who can lawfully enter into and form contracts on the website in accordance with English Law. 

In order to make purchases through the site, you will be requested to register and provide your personal details.  In particular, customers must provide their real name, telephone number, email address and other requested information as indicated.

The website is available for non-commercial and domestic use only. DGM reserves the right to refuse orders from businesses or that we consider are for commercial or other non-domestic concerns.  We also reserve the right to restrict multiple quantities of an item being shipped to any one customer or postal address.

Product Information

We have made every effort to display as accurately as possible the colours of our products that appear on the website.  However, as colour clarity will depend on your personal monitor, we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the product on delivery.

All sizes and measurements are approximate; however we do make every effort to ensure they are as accurate as possible.

We will take all reasonable care to ensure that all details, descriptions and prices of machinery, equipment and accessories appearing on the website are correct at the time when the information was entered on the system. We reserve the right to refuse to supply an order where information has been mis-published including prices and promotions. 

DGM will do its best to correct errors and omissions at the earliest possible time on notification.

All prices are inclusive of V.A.T.

Your Order

When you order an item from DGM you are offering to buy it for the price stated.

All orders are subject to acceptance by DGM and to availability.

When you place an order Worldpay, our payment processor, will send you an email acknowledging exact details of your order and the value which will be debited from your credit/debit card.

Please note that our products for sale are those in stock and available for dispatch.  If there is a delay between the time when the order is placed and the time when the order is accepted, the stock position relating to the particular items may change. If Goods ordered are no longer available DGM will cancel the order and any payment made will be refunded in full.  We will not make any substitutions.  If this is the case we will email you and let you know that we are unable to fulfil your order and/or notify you of an alternative delivery date.

At the moment that the goods are ordered, a contract will be made between you and us, and you will be charged for the goods.  Our acceptance of your order will be deemed complete and received by you at the time and date of sending of the email, which time and date is specified on the email.  The deemed time and date of receipt by you shall apply regardless if whether, for reasons outside our control, you have not received that email.

DGM reserve the right to refuse an order placed by you.

Payment Options

We accept payment by all major credit/debit cards except American Express and Diners Club.  

The price you see is the price you pay for each item.

We only accept payment in British Pounds Sterling (£).    

All prices are inclusive of V.A.T.

Credit Card Validation:  All credit/debit cardholders are subject to validation checks and authorisation by the card issuer.  If the issuer of your payment card refuses to or does not authorise payment for any reason then we will notify you by email and not dispatch the order.

Right of Cancellation

Should you wish to amend or cancel your order please contact us at info@devongardenmachinery.co.uk

We advise you to check the status of your order before you request cancellation. 

You will be liable for any charges incurred in returning the goods to DGM

Intellectual Property

The content of this website is protected by copyright, trade marks, database right and other intellectual property rights and is for your personal, non-commercial, use only. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the website without written permission from DGM.

Governing Law

These Terms and Conditions are subject to the laws of England and the jurisdiction of the English court.

Privacy

You acknowledge and agree to be bound by the terms of our privacy policy.

This website is owned and operated by DGM whose principal place of business is at Kerswell Gardens, Newton Road, Torquay, Devon, TQ2 7HX.

DGM may change or withdraw any part of the website or may refuse you access to the website at any time if we consider it necessary.
